Who Has Payment Priority?

As part of the Chapter 13 bankruptcy process, a bankruptcy court trustee may meet with you and your creditors at a confirmation hearing to put together your Chapter 13 debt repayment plan. At this meeting, it will be determined which creditors have priority for receiving payment through the bankruptcy plan.

In most cases, government creditors will receive the highest priority. Once the plan is in place, your monthly payments will start, typically lasting between three and five years. After the plan is complete, many of your remaining unsecured debts will be discharged, leaving you free to begin rebuilding your credit.
